When Points Suspend a License
Florida tracks points against three separate, rolling time windows at once. Hitting any one of them triggers a suspension.
These three windows run independently and simultaneously. A driver who spaces tickets out to avoid the 12-month threshold can still hit the 18-month or 36-month threshold without realizing it. Points are counted from the date of the offense, not the date of conviction, and out-of-state tickets can add Florida points too, if the same offense would have earned points here.
How Many Points Is Your Ticket?
Florida assigns a fixed point value by statute for each violation type. This covers the violations that generate the most tickets.
Point values are set by Florida Statute and apply uniformly across the state. This chart covers common violations; less frequent citations may carry different values. A camera-issued red light ticket does not carry points at all, unlike a red light citation issued directly by an officer, which does.
What a Ticket Does to Your Insurance
For most drivers, the insurance increase costs more over time than the ticket itself.
- A 3-point ticket typically raises an annual premium by roughly 20 to 30 percent.

- A 6-point violation, like an at-fault crash, can push a premium up 40 to 70 percent, and some carriers decline to renew a policy at 9 or more points in a single term.
- These increases commonly last 3 to 5 years, even though the points themselves may drop off the driving record sooner.
Pay It, Take a Course, or Fight It?
The citation itself usually lists none of these options clearly. Here is what each one means.
Paying the Ticket
Paying is a guilty plea. It results in a conviction, the points are assessed, and the insurance impact begins. This is the fastest option and, for a minor first violation, sometimes the most practical one.
Electing Traffic School
Basic Driver Improvement (BDI) school withholds adjudication for eligible citations, meaning no points are added for that specific ticket. It can be used once a year and up to five times in a lifetime, but it does not remove points already on the record from earlier violations, and some citations require the course regardless of which option is chosen.
Fighting the Ticket
Contesting the citation means requesting a hearing and challenging the evidence behind it, such as radar calibration, the officer’s certification, or the facts of the stop itself. This makes the most sense when a conviction would push a driver close to a suspension threshold, when a CDL or a driving-dependent job is at stake, or when the underlying evidence is genuinely weak. How Contesting a Ticket Works in Miami-Dade
Miami-Dade County follows a specific process for contesting a citation, separate from the general Florida framework. Understanding it before the 30-day window closes matters.
Upon receiving a citation, a driver has 30 days to choose one of three options: pay the fine (points assessed), attend driver improvement school (no points, limited to five times in a lifetime and once every 12 months), or request a hearing.
The Eleventh Judicial Circuit, which covers Miami-Dade, also offers Online Dispute Resolution for many traffic citations. A hearing officer can review the submitted documents and resolve the case remotely, without requiring a court appearance at all. For drivers who cannot attend court in person, Miami-Dade also allows a plea of not guilty in absentia: posting a bond by mail with a notarized affidavit of defense in place of a personal appearance.
Missing the 30-day window does not end the case, but it gets more expensive. A ticket between 31 and 180 days old requires a 16 dollar late fee to get the case set for court. After 180 days, a written motion to an administrative traffic judge is required to proceed at all.
One detail that surprises many drivers: for a civil traffic infraction in Miami-Dade, there is no right to a jury trial and no court-appointed lawyer. A driver can represent themselves or retain an attorney, but the case does not come with a public defender the way a criminal matter would.

Can an out-of-state ticket add points to my Florida license?
Yes. Florida assesses points for an out-of-state conviction if the same offense would have earned points under Florida law, regardless of how the other state handled it. A driver cannot avoid Florida points simply because the citation happened elsewhere.

A serious traffic violation, including speeding 15 mph or more over the limit or reckless driving, counts toward disqualification thresholds separate from regular points: two serious violations within three years typically results in a 60-day disqualification, and three within three years can mean 120 days. CDL holders generally cannot use a driver improvement course to avoid these consequences the way non-commercial drivers can, and this can apply even when the violation happened in a personal vehicle rather than a commercial one.
